1. Acceptance of Terms

By accessing and using SaveMyBlog ("the Service"), you accept and agree to be bound by the terms and provision of this agreement. If you do not agree to abide by these terms, you are not authorized to use or access this Service.

2. Service Description

SaveMyBlog provides a web-based service that helps users migrate their content from TypePad blogs by:

• Analysing TypePad export files
• Downloading blog assets (images, PDFs, and other files)
• Creating downloadable archives of blog content
• Generating WordPress-compatible import files

3. Data Processing and Privacy (GDPR)

In accordance with the General Data Protection Regulation (GDPR) and French data protection law (Loi Informatique et Libertés):

3.1 Data Controller

SaveMyBlog acts as data controller for personal data processed through our Service. Our legal basis for processing is legitimate interest in providing migration services and contract performance.

3.2 Data Collection and Processing

• Account Data: Email address for account creation and communication
• Upload Data: TypePad export files containing your blog content, posts, comments, and media
• Technical Data: IP addresses, browser information, and usage logs for service operation and security

3.3 Data Retention

• Free users: Files available for immediate download only
• Individual plan: 3 months secure cloud hosting (Amazon S3)
• Pro plan: 6 months secure cloud hosting (Amazon S3)
• Account information is retained until account deletion
• Technical logs are retained for 30 days for security purposes

3.4 Your Rights (GDPR)

You have the right to:

• Access your personal data
• Rectification of incorrect data
• Erasure of your data ("right to be forgotten")
• Data portability
• Object to processing based on legitimate interests
• Lodge a complaint with the CNIL (French data protection authority)

4. User Responsibilities

You agree to:

• Only upload content you own or have rights to migrate
• Not upload malicious, illegal, or harmful content
• Comply with applicable laws and regulations
• Not attempt to circumvent service limitations
• Download your migrated content promptly (we recommend downloading immediately, though paid plans include cloud hosting)

5. Service Availability and Limitations

This Service is provided on a "best effort" basis. We cannot guarantee:

• 100% uptime or availability
• Successful download of all images and files (some may be missing or unavailable on TypePad servers)
• Complete migration of all content
• Compatibility with all blog configurations
• Data persistence beyond our stated retention periods

Important: You are responsible for verifying that all exported files and images have been correctly retrieved. We recommend thoroughly checking your downloads before the TypePad shutdown. We cannot verify the completeness of your migration.

6. Intellectual Property

You retain all rights to your content. We do not claim ownership of uploaded materials. Our Service and software remain our intellectual property. You grant us a limited license to process your content solely for providing the migration service.

7. Limitation of Liability

To the extent permitted by French law, SaveMyBlog's liability is limited to the amount paid for the service. We are not liable for:

• Loss of data due to user error or external factors
• Unavailability of source content on TypePad servers
• Indirect, consequential, or special damages
• Business losses or lost profits

8. Payment Terms

Paid plans are processed securely through Stripe. Payments are non-refundable except as required by French consumer law. EU customers may be entitled to a 14-day cooling-off period for distance contracts.

9. Termination

We may terminate access for violations of these terms. You may terminate your account at any time. Upon termination, your data will be deleted according to our retention policy.

10. Governing Law and Disputes

These terms are governed by French law. Any disputes shall be resolved in French courts. EU consumers may also access the EU Online Dispute Resolution platform.

11. Changes to Terms

We may update these terms with 30 days notice via email or service notification. Continued use constitutes acceptance of updated terms.
